How are trans detainees treated in custody?

It is important that trans detainees receive the same respect and dignity as any other member of the public. There is also a requirement to be sensitive to the dignity of police officers or detention officers who are required to conduct search procedures.

Legally, the sex of a person is that which was registered at the time of their birth, except as provided for under section 9 of the Gender Recognition Act 2004. However, rigid adherence to this principle is too inflexible and can lead to unnecessary distress and confrontation. Dealing with detainees with respect and consideration increases the likelihood of cooperation and decreases the level of risk and vulnerability posed.
