FREEDOM OF INFORMATION REQUEST REFERENCE NO: RFI 6484/15

I write in connection with your request for information which was received on 27th July 2015. Please find below the response to your request:

For the last 5 years, with regards to sexual assaults against females aged 16 and above:

With regards to sexual assaults against females aged 16 and above, could you please answer the following:

1.  The number of rape claims made and whether against a stranger or a partner/spouse.

2.  The number of rape claims investigated and whether against a stranger or a partner/spouse.

3.  The number of rape claim prosecutions and whether against a stranger or a partner/spouse.

4.  The number of rape claim convictions and whether against a stranger or a partner/spouse.

5.  The number of rape claims found to be false and whether the claim against a stranger or a partner/spouse.

6.  The number of false rape claims resulting in a caution for the reporter and whether the claim was against a stranger or a partner/spouse.

7.  The number of false rape claims resulting in a conviction for the reporter and whether the claim was against a stranger or a partner/spouse.

8.  Your specified criteria/policy for being able to charge someone for making a false rape claim.

REPLY 1 - 7: Please be advised that all the information you have requested is not available in a readily retrievable format. We are unable to provide information regarding the role relationship between the victim and offender as this is not electronically retrievable and would require a manual review of all the 1235 rape claim records made for the period requested. Therefore the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the 'appropriate level' as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and if one part of a request exceeds the fees limit then S12 of the Act applies to the whole request

However, In accordance with Section 16 of the Act I have a duty to provide advice and assistance in relation to your request and have provided the information that we are able to retrieve without the role relationship included as this was retrieved during our initial research. This should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests.

Regarding question 4, Her Majesty`s Courts Service (HMCS) should be contacted for comprehensive conviction figures

REPLY 8: No specific recorded information held.

To explain further, There is no set policy for dealing with such instances. It would be for the Officer in Charge/CID management team to review the circumstances and decide an appropriate course of action.

To charge with perverting the course of justice would have to go via the CPS for a charging decision.

If it could be proved absolutely that the rape/sexual assault did not happen (eg CCTV, admission, witness evidence) then a fixed penalty ticket would be issued for wasting police time. This is a police decision.

In both circumstances it would be on a case by case basis and for local CID management to decide which course of action to take, if any.
