I am after the following documents and information:

Confirmation as to who is the data controller for the use of these cameras How the roads were chosen for this deployment Relevant documentation relating to the use of these cameras including but not limited to:

- DPIA screening questionnaires

- DPIA documentation

- Contractual checks on camera/software equipment supplier compliance

- Other relevant GDPR documentation that shows compliance

Confirmation as to who is the data controller for the use of these cameras

The data controller for West Mercia Police is the chief constable. However, the response in relation to DPIA concerning cameras is relevant as the cameras are exempt.

How the roads were chosen for this deployment

Cameras have been selected for deployments based around two categories.

1. Casualty reduction - Where a site is highlighted due to high incidents of road traffic collisions and injuries due to speed related causations that site will be subject to scrutiny for suitability as a casualty speed reduction enforcement site.  This may be using mobile camera technology or fixed camera systems.
2. Community concern – Where public concern highlights an area of concern over excessive speeds at a particular site, a speed survey is carried out.  When speeds are found to be excessive then the site may be selected as a community concern enforcement site, again using mobile or fixed technology.

All sites are reviewed every six months to ensure the need for enforcement continues.

West Mercia police hold no information requested in relation to DPIA and GDPR in respect of speed and red-light cameras.  All devices used in traffic enforcement are Home Office Type Approved devices and as such meet the exemption given by the Information Commissioner on the Surveillance Camera Code of Practice.  The Code is available to the public at:  Surveillance Camera Code of Practice (publishing.service.gov.uk)

The footnote on page 5 says:

“1 Excludes any camera system with relevant type approval of a prescribed device under Section 20 of the Road Traffic Offenders Act 1988 used exclusively for enforcement purposes, which captures and retains an image only when the relevant offence is detected and with no capability to be used for any surveillance purpose. For example, for the enforcement of speeding offences.”

As such no information relating to DPIA and GDPR is held in respect of the enforcement systems because the DPIA and GDPR is not engaged in creating the information you request..
